The court observed that the auction for allotment of shops was held in 2020, while the petitioners were elected as corporators in 2021 and took oath in 2023. Hence, it ruled that there was no misuse of official position by the petitioners.

With this observation, the court held that disqualification under Section 26(1)(K) of the Karnataka Municipal Corporation Act, 1976, was not applicable. The verdict is expected to have political implications in Belagavi.
